No grounds for instituting an inquiry into Public Protector

The Office of the ANC Chief Whip applauds the decision by Parliament's Portfolio Committee on Justice and Correctional Services that there is no basis to institute removal proceedings against Public Protector, Adv. Busisiwe Mkhwebane.

The committee today also resolved that the request for an inquiry into the Deputy Public Protector Adv. Kevin Malunga was unfounded.

The committee received a letter from the Office of the Public Protector indicating that the allegation that the Deputy Public Protector had unlawfully closed an investigation was false, and that the investigation the DA referred to in their letter of complaint is still ongoing. This demonstrates the desperate lengths the DA would go to in pursuit of their witch-hunt against the Office of the Public Protector.

The ANC's principled support of both Adv. Mkhwebane and Adv. Malunga is based on their continued commitment to serve the masses of South Africa without fear or favour. We reiterate that judicial review of the Public Protector's rulings, as provided for in our legislation do not render the incumbent unfit for office as the opposition would want us to believe. We applaud the committee for rejecting this public stunt by the DA which seeks to demean and erode the integrity of the Office of the Public Protector.

We also want to correct misleading media reports claiming that the committee had previously resolved to conduct an inquiry into the fitness of the Public Protector to hold office. A previous meeting of the committee had voted on whether the justice committee was the correct forum to deal with the referral from the Office of the Speaker on this matter. The vote was merely on who should deal with the request. Thus the committee had not resolved on the merits of the allegations contained in the complaint of the DA. It is only upon having considered the merits of the allegations today that the committee resolved that there was no substance to the DA's request for parliament to institute removal proceedings against the Public Protector.

The ANC in Parliament fully supports the committee's resolution that these complaints are nothing but a shameful attempt to blemish the integrity of the incumbents in the Office of the Public Protector.
