ANC pleased with ratification of treaty Mutual Assistance in Criminal Matters between RSA and UAE

Honourable members, on behalf of Portfolio Committee (PC) on Justice and Correctional Services. I hereby present these reports which were adopted by the PC unanimously to this Honourable House, for approval and ratification of the Extradition and Mutual Legal Assistance, in Criminal Matters Treaties, between the Republic of South Africa (RSA) and the United Arab Emirates (UAE) into Section 231 (2) of the Constitution of RSA.

We need treaties to fight transnational crime and to hold criminals accountable. Currently, we don't have such agreements with the UAE and without them, we must rely on goodwill. This is an obvious challenge in the fight against crime. The advantage that treaties provide is for a legal process whereby SA and the UAE can make bans and receive requests for extradition. What we must ensure is that those who surrender are not subjected to cruel, inhuman or degrading treatment and that their right to a fair trial is granted. In the light of the above, we also note that South Africa will not be a safe haven for criminals, it is recommended that Parliament approve the ratification of the said Treaties.
